Introducing More Ways to Communicate about GPSNR

The COVID-19 pandemic is impacting the entire natural rubber supply chain. It has triggered car and tire manufacturing companies to operate with a reduced workforce, or temporarily halt production plants altogether. Strict lockdown measures have caused a drastic fall in the sales of consumer tires across Europe. Global demand for natural rubber has dropped, the effects of which will be felt by the 6 million natural rubber smallholders in Asia, Africa and Latin America.

Many smallholders live in poverty, depending on daily wages to feed their families. Their situations will only be exacerbated by the COVID-19 crisis. Already, the Association of Producers and Processing Plants of the State of São Paulo (APABOR) has estimated that for Brazil alone, the subsistence of around 100,000 natural rubber farmers and their direct relatives is at risk.

While COVID-19 exposes the vulnerabilities of smallholders, it also reveals the potential they have to be agents of change and drivers of transformation. The pandemic has reminded us of the connections between human health, resilient landscapes, economic stability and livelihoods; the post COVID-19 world is more likely to devote greater attention to tackling environmental, social and economic impacts of its many supply chains. Smallholders, who produce 85% of the world’s natural rubber supply, are thus key to advancing GPSNR’s vision of a fair, equitable and environmentally sound rubber value chain.

One of GPSNR’s major outcomes for this year has been welcoming our new smallholder members. As of today, a total of 27 smallholder members (with additions from Myanmar) have joined GPSNR. The inclusion of smallholders into the fabric of the Platform provides them the opportunity to drive the agenda for sustainable natural rubber and, in the long-term, realize the social, economic and environmental benefits that sustainability brings. 

We encourage GPSNR members to communicate this outcome through the communication channels of their respective organizations. To this end, we launched a quarterly Members’ Communication Toolkit which outlines the suggested key message and provides ready-to-use content for communicating the message. GPSNR Members may access the Members’ Communication Toolkit for Q2 2020 in the GPSNR Forum.  

More is being done to fully include these smallholders in the Working Groups and Executive Committee. The Smallholders Representation Working Group continues with its efforts in designing a programme for onboarding smallholders prior to the General Assembly. In the meantime, some of our new smallholder members are already actively involved in Working Group discussions. Additionally, having recognized the urgency to address the impacts of COVID-19 on smallholders, the Equity sub-Working Group is developing a position paper on the issue.

GPSNR Working Groups Update: November 2023

Strategy and Objectives Working Group: Following the approval of the Assurance Model resolution (5b), the Assurance Model Task Force is working with ASI in developing the Assurance Model including aligning with current normative documents, engaging members for consultation, and pilot testing.

In parallel, the Risk Subgroup hosted a webinar focused on traceability and shared findings from their traceability pilot projects. 

The Risk subgroup has decided to temporarily pause its activities until December, allowing time for ASI to complete the Assurance Model alignment. ASI has commenced its task of aligning key GPSNR documents. These documents aim to lay a solid foundation for the complete Assurance Model. Upon the completion of this alignment process, the fully drafted Assurance Model will be presented to the members for consideration and approval.

Smallholders Representation and Capacity Building (SCB) Working Group: The Indonesian subgroup presented their quarterly reports for two GAP Coaching projects and one Disease Fighting project on October 27, 2023. In addition, GPSNR secured a joint collaboration letter with RAOT and invited all member companies to participate in the Thailand GAP coaching project in Bueng Kan and Chiang Rai provinces. The Thailand agroforestry project also received additional funding for further sub-projects.

The Digital Knowledge Sharing Platform (KSP) task force conducted a pilot user acceptance test and initiated socialisation sessions and training for smallholder farmers in Indonesia. They also announced a Request for Proposal (RFP) for KSP’s third phase, focusing on content development, with submissions due by November 24, 2023.

Rubber agroforestry workshops were held in Côte d’Ivoire from October 25-27, 2023, and information on capacity-building projects open for funding was shared with all members. The SCB WG will continue to oversee all ongoing projects, with efforts to plan logistics for smallholder representatives attending events in Thailand and France. The Thailand agroforestry subgroup is working on a supplemental agreement for additional projects.

The KSP task force plans to continue socialisation sessions and training in Indonesia and Thailand, aiming for the final user acceptance test by the end of November 2023. By the end of November, the task force will begin evaluating proposals for KSP’s third phase.

The Income Diversification and Rubber Agroforestry task force is preparing for its second Indonesian agroforestry workshop of 2023, scheduled for November 22-24. Additionally, a webinar is planned for November 30, 2023, to present findings from the HCSA-HCVN field trial.

Policy Toolbox Working Group: On November 22nd, WG1 met to discuss the  quantification of the RR, data aggregation methodologies, and updates relating to the RR in the context of the Assurance Model. During the meeting, operational timelines and survey to gather information were set up.

Currently, Agridence is developing the digital platform, and the Secretariat plans to provide updates on the RR to ensure the platform is operational before the 2024 reporting cycle.

WG1 is also working on revising the Code of Conduct to include non-conformance measures for failing to update the Reporting Requirements, in line with the non-conformance measures approved by the Executive Committee in 2022.

Lastly, following the approval of the revised reporting requirements, the WG will proceed to develop the disclosure requirements for the Year 3 reporting cycle.

Shared Responsibility Working Group: The Assurance Model will be meeting with ASI to provide feedback on the proposed Assurance Model under development. Additionally, the Working Group has an open co-chair seat and is calling for volunteers to fill this position.

GPSNR supports the inclusion of smallholder farmers in EU natural rubber supply chains, and affirms their customary and native land use rights

Smallholder farmers are key stakeholders in natural rubber supply chains accounting for 85% of global supply, and enabling the resilience and sustainability of the value chain. However, smallholder farmers are the most vulnerable to major changes in the economic and regulatory landscape. Their vulnerability is heightened by the fact that many smallholders lack formal land documentation. Fortunately, many rubber producing countries are progressively implementing land tenure formalization programmes for smallholders but they undoubtedly will take significant amounts of time to fully implement.

The Global Platform for Sustainable Natural Rubber (GPSNR) supports the intent and implementation of the EU Regulation on Deforestation-free products (EUDR), and considers it a bold and necessary step to addressing deforestation, human rights violations, and illegality in commodity production, including natural rubber. However, it is key that its implementation ensures the continued inclusion and support of smallholders in EU supply chains.

GPSNR includes more than 200 smallholder farmers from 12 countries in its membership and has heard their concerns regarding the potential unintended consequences of the law.

As reflected in its Policy Framework, GPSNR is committed to recognise and protect the customary, traditional and communal land tenure and use rights of Indigenous People and local communities (IPLC), including smallholder farmers who have such rights, even in cases where they are not formalised yet in the legal system of the country in which they reside.

In view of supporting the inclusion of smallholders in EU supply chains, while ensuring due diligence against illegality, the GPSNR requests the European Commission provide additional EUDR guidance to competent national authorities regarding how to effectively check that operators and traders have conducted sufficient due diligence to determine the legality of commodities falling within the scope of the Regulation considering the mosaic of native and customary land rights arrangements found on smallholder farms around the world. Examples of how this could be achieved might include: 

  •  The creation of a shared information system amongst competent national authorities to assess the practical state of producing countries’ efforts to document and formalize recognition of customary land tenure arrangements for smallholder farmers;

     

  • Work with producer country governments to identify prevalence of customary tenure.

     

  • Providing practical guidance to EU competent authorities and regulated companies on:

     

    o How to robustly assess and map the customary land title claims in each country to ensure smallholders are not cut out of supply chains before formal land registries are created and protect the right to self-determination of IPLCs who do not wish to engage in land title formalisation even if it becomes available. 

    o In countries where formalization of land tenure is still under development, prioritize assessment of legality to establish that commodities placed on the market do not originate from land that has been occupied or acquired in violation of national land laws or customary tenure arrangements (i.e., through a “land grab”); through dispossession or abuse of the rights of vulnerable members of a population by elites; or which is located within prohibited areas such as national parks, wildlife reserves, or other protected areas, or from other restricted use areas.

    o Specifics on the types of documentation to collect to substantiate the rights (formal or customary) of smallholder farmers to use land parcels for the production of the relevant commodity. This could include documentation recognized by local authorities, or other evidence of locally recognized land tenure, and evidence that key regulatory bodies in producing countries have indicated general acceptance that smallholder farmers cultivating land under customary and/or communal land tenure arrangements may legally produce and sell rubber (this may be explicit – e.g., through a license – or implicit, e.g. through the provision of official extension support, credit schemes, or marketing assistance to registered smallholders);

We call the Commission and other EU and national institutions for a joint effort to enable smallholder farmer organizations to meet EUDR compliance; and proactively work with the producing countries to address potentially conflicting national laws, issues of inadequate law enforcement and corruption, and provide support to producing countries to tackle these issues and empower smallholders to maintain access to EU markets. GPSNR commits to support just transitions to secure forms of land tenure. We will collaborate with members to enhance capacity in land tenure and support programs facilitating smallholders’ access to formal land documentation where applicable.

Finally, we wish to clarify that the above proposals are in no way intended to avoid compliance by GPSNR operators and traders purchasing and selling natural rubber products covered under the scope of the Regulation. Rather, they are designed to support and enhance the position of the six million smallholders in global rubber supply chains to help realize the potential of the law, whilst themselves benefiting from it. These proposals are supported by GPSNR’s smallholder and civil society representatives, alongside industry members.

The GPSNR Executive Committee has sent this letter to the European Commission for further deliberation.
